$90,000 fine for second offense for window manufacturer

A worker was critically injured trying to remove a piece of aluminum from a punch press. A inspection by the Ministry of Labour found that an exposed moving part lacked proper guards to prevent access. The company had previously been convicted under the same subsection of the regulations.

The company had failed as an employer to ensure that the measures and procedures required by section 24 of Regulation 851 (the Industrial Establishments Regulation) were carried out in a workplace, contrary to section 25(1)(c) of the Occupational Health and Safety Act.
